Terms of Service

1. Acceptance of terms

By downloading, installing, or using LinguaLens ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply in addition to Apple's standard End User License Agreement (EULA), which also governs your use of apps distributed through the App Store. In the event of conflict, Apple's EULA takes precedence with respect to App Store rules; these Terms govern all other matters.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store usage rules.

You may not:

• Sublicense, sell, resell, transfer, or assign your license to any third party
• Modify, reverse-engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels in the App
• Use the App to build a competing product or service

3. Your content and your responsibility

3.1 You own your content

LinguaLens processes files that you provide. We do not claim ownership over any audio, video, transcripts, or translations created using the App. All output generated from your content belongs to you, subject to the rights of the original content owners.

3.2 Your responsibility for content rights

You are solely responsible for ensuring you have the legal right to transcribe and translate any content you process with LinguaLens. This includes, but is not limited to:

• Files you have created yourself
• Files licensed to you for personal use
• Content in the public domain
• Content for which you hold explicit permission from the rights holder

3.3 Prohibited uses

You may not use LinguaLens to:

• Infringe the intellectual property rights of any third party
• Process content that contains illegal material, including child sexual abuse material
• Circumvent digital rights management (DRM) protections
• Generate subtitles or transcripts intended to defame, harass, or harm individuals
• Use outputs to spread misinformation or create deceptive content
• Violate any applicable local, national, or international law or regulation

4. Transcription and translation accuracy

Accuracy varies based on audio quality, accent, background noise, technical vocabulary, and language pair. We make no representations about the fitness of the App's output for any particular purpose.

Factors that typically reduce accuracy include: low-quality audio, multiple overlapping speakers, heavy background noise, non-standard accents, and languages other than the 19 supported languages.

5. LinguaLens Pro

5.1 What Pro includes

LinguaLens Pro is an optional upgrade that provides access to Azure Neural TTS voice synthesis and removes any usage limitations present in the free tier. Pro features are detailed in the App and are subject to change with reasonable notice.

5.2 Billing and cancellation

Pro is offered as a one-time purchase or subscription, processed entirely through Apple's App Store billing system. All refund requests, billing disputes, and cancellations are handled by Apple in accordance with their standard policies.

To cancel a subscription: open the App Store → tap your account → Subscriptions → LinguaLens → Cancel. Cancellation takes effect at the end of the current billing period.

5.3 Refunds

Refunds are subject to Apple's App Store refund policy. We do not process refunds directly. For assistance, contact Apple Support at reportaproblem.apple.com.

5.4 Changes to Pro

We reserve the right to modify, add, or remove Pro features with reasonable advance notice. If we remove a feature you paid for, we will notify you in advance. Continuation of your subscription after such notice constitutes acceptance of the change.

6. Third-party services

The App integrates the following third-party services. Your use of these services through the App is subject to their respective terms:

• Apple Translation API — on-device translation, subject to Apple's platform terms
• Microsoft Azure Cognitive Services — TTS for Pro users; subject to Microsoft Azure Terms

We are not responsible for the availability, accuracy, or actions of these third-party services.

7. Intellectual property

The App, including its name, logo, design, interface, and underlying code, is owned by LinguaLens and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in the App beyond the limited license described in Section 2.

"LinguaLens" and the LinguaLens logo are trademarks. You may not use them without our prior written permission.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that: (a) the App will be uninterrupted or error-free; (b) transcription or translation output will be accurate or complete; (c) the App will be available at any particular time; or (d) any defects will be corrected.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM RELIANCE ON INACCURATE TRANSCRIPTIONS OR TRANSLATIONS.

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid for LinguaLens Pro in the twelve months preceding the claim, or USD $10, whichever is greater.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

11. Updates and changes

We may update the App or change its features at any time. We may also update these Terms. When we make material changes, we will update the effective date above. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

If you do not agree with a material change, your remedy is to stop using the App and, if applicable, cancel your Pro subscription before the change takes effect.

12. Termination

We may suspend or terminate your access to the App at our discretion, with or without notice, if we believe you have violated these Terms. Upon termination, your license to use the App ends. Sections 3, 7, 8, 9, and 13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of [Jurisdiction], and you consent to personal jurisdiction in those courts.

Notwithstanding the above, Apple has the right (but not the obligation) to enforce these Terms as a third-party beneficiary in its capacity as the App Store distributor.

14. Apple-specific terms

As required by Apple's App Store guidelines, the following applies:

• These Terms are between you and LinguaLens only — not Apple.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, intellectual property infringement claims, or legal/regulatory compliance.
• You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
